1. Purpose and Scope of Bow Miner Terms of Use
1.1. These rules for the provision of services by Bow Miner https://www.88miner.com/ (hereinafter referred to as the “Rules”) define the requirements and describe:
1.1.1. The procedure for providing Bow Miner cloud mining services;
1.1.2. Bow Miner is publicly available for sale to users;
1.1.3. Allocation of responsibilities related to the use and provision of Bow Miner;
1.1.4. Measures to reduce the risks of money laundering and terrorist financing.
1.2. Bow Miner or the Service refers to the system that allows users to use cloud mining services, located and operated on the website “https://www.88miner.com/”.
1.3. The place where the service is provided to users is the location of the servers where user data and transactions are recorded and processed.
1.4. Before using Bow Miner, users must read and accept the Terms of Use and Privacy Policy posted on the website.
1.5. Users may use Bow Miner only if they accept these Terms in full.
1.6. The latest version of the Terms is publicly available on the Service Website. The Service Administration reserves the right to unilaterally modify the Terms at any time. Such modifications will enter into force 3 (three) calendar days after the publication of the new version of the Terms on the Website, unless otherwise expressly provided in the new version of the Terms. If the User does not accept the modifications, he must refuse to access the Service Website and stop using the Service's resources and services by sending an email to the address specified on the Website.
2. Terms and Definitions
2.1. KYC and AML stand for "Know Your Customer" and "Anti-Money Laundering", respectively.
2.2. An Account is a unique account on the Service that identifies a User.
2.3. A blockchain is a continuous, ordered, rule-based chain of blocks (linked lists) containing information about transactions between Users' digital keys (wallets) and capable of being transmitted from one computer (person) to another via the Internet.
2.4. Card verification is the process of verifying that payment information (bank card, account or electronic wallet) belongs to its owner. The Service specifies the conditions for verifying the cardholder's ownership; this verification takes place each time the User makes a payment (credit card, bank account or e-wallet) or each time the Service decides to make a payment.
2.5. An Order is a way for the User to express his willingness to use the Service by filling in an electronic form on the Service's website and is subject to the terms and conditions specified in the Order settings.
2.6. Cryptocurrency: Bitcoin, Litecoin, Ethereum and any other currency based on blockchain technology.
2.7. Exchange rate: the exchange rate between cryptocurrencies, electronic currencies and legal tender.
2.8. National currency (legal tender): the legal tender of the corresponding country (USD against USD, etc.).
2.9. A Partner is a natural person who provides services to the Service and attracts Users, the conditions of which are specified in the Terms.
2.10. Payment is the transfer of cryptocurrencies, electronic currencies or legal tender between Users, or between Users and the Service.
2.11. A payment system is a software and hardware product developed by a third party for recording debts between Users and organizing mutual payments.
2.12. The User is a natural person who has reached legal age and has the capacity to act, or a legal person who uses the Service.
2.13. The Service is a system that allows the User to use cloud mining services, available on the website "https://www.88miner.com/".
2.14. Notification: by email or by letter sent through the support section.
2.15. Means: Cryptocurrency, electronic money and legal money in accordance with the provisions of Article 5 of these Regulations.
2.16. Services: rental of cryptocurrency mining equipment and other services, the relevant information of which is published on the Service website.
3. Maintenance mode
3.1. Normal mode:
3.1.1. In this mode, the User's request in the "Support" section will be processed within the time specified in the rules: 1 hour.
3.1.2. The Website Operator will provide support to the User through other communication channels in accordance with the terms and conditions on the Service website.
4. Rules for the use of the Bow Miner website account
4.1. The Service is for personal use only. By registering on the Website, the User agrees to provide Bow Miner with accurate personal information in accordance with the registration procedure. The User also agrees not to use any account that is not his own and not to attempt to gain unauthorized access to other User's accounts or the Service infrastructure.
4.2. The Service reserves the right to perform additional verification of User information and to request any necessary documentation from the User for any reason related to the User's use of the Service and/or as proof of the information provided by the User to the Service.
4.3. The Service Administration may, at any time and at its sole discretion, refuse to open an account for the User, freeze the account or suspend any transaction until the information provided by the User has been reviewed.
4.4. The Terms of Use prohibit the User from having multiple registered accounts.
4.4.1. If the Administration discovers that a User has multiple accounts, it reserves the right to block all accounts of the User.
5. Rules of Use of the Affiliate Program
5.1 Fees incurred under the Affiliate Program will be credited to the Personal Account of the Service in US dollars.
5.1.1 The value of the Affiliate Rewards described in point 5 may change over time. In this case, all earned funds will remain in the account.
5.2 A User is not considered a unique User (not counted by the Service) if: in the past 3 months, the User's IP address has been linked to our website using the same affiliate link;
5.3 The Service Rules prohibit the use of referral links to create duplicate accounts of oneself;
5.4 It is prohibited to accept payments for services such as mining on behalf of the Service;
5.5 Partners who violate the above rules may be excluded from the Affiliate Program. All referrals will be considered Bow Miners, and the accumulated Affiliate commissions will also be considered Bow Miners.
5.6. The Service has the right to delay the payment of Affiliate remuneration for 30 days for attracted customers who pay with a bank card and are in the list of potentially risky transactions according to the anti-fraud filter.
5.7. If the transaction of the attracted customer is considered fraudulent, the Partner remuneration for this transaction will not be paid.
5.8. The Partner is fully responsible for the security of the authentication data (username and password) used to access his account.
5.9 These conditions may be modified unilaterally without notifying the Program Participants, but by publishing them on this page.
6. Procedure for providing the Service
6.1. The User subscribes to the Service by creating an account and purchasing the necessary amount of electricity as part of the Pay-As-You-Go service offered on the Service's website.
6.2. By using the Service, the User confirms his legal ownership, use and disposal of cryptocurrencies, electronic money and fiat currencies used in the Service.
6.3. The Service does not accept or send cryptocurrencies, electronic money or fiat currencies to third-party accounts other than the User. The Service does not provide services to bank cards (accounts) that do not belong to the User. The Service does not establish any partnership with any merchant or service company and is not a mutual settlement agent for transactions between the User and third parties.
6.4. By making a purchase, the User has the opportunity to rent equipment from the Service for the period specified in the chosen tariff.
6.5. To make a purchase, the User must first top up his account by choosing one of the top-up methods offered in the "My Account" section.
6.6. Withdrawal of accumulated funds by simple request.
6.7. If suspicious activity is detected during the execution of the User's order, the Service reserves the right to suspend these operations until the cause of the activity is determined, in order to avoid any losses. 6.8. If the User does not provide complete and sufficient data required for his/her identity, the Service reserves the right to refuse to provide the Service and to freeze the funds received from him/her until the User submits such data and completes his/her KYC procedure again.
6.9. The Service will do its best to provide the Service and access to the website https://www.88miner.com/ in accordance with these regulations. However, the Service may suspend the use of the website for maintenance reasons and will try to notify the User in advance. The User hereby agrees to bear the risks arising from the inability to use the Service or to trade through his/her User account. 6.10. If the User is suspected of receiving funds through illegal activities, the Service reserves the right to terminate the contract in accordance with the laws of the country where the Service is registered or the country where the User resides.
6.11. At night, the Service operates in automatic mode.
6.12. When processing mining contracts or customer support requests, the Service Administration reserves the right to:
6.13.1. To terminate all communications with the User if the User violates the rules of commercial communications, asks questions unrelated to the provision of the Service, or does not provide information required for the provision of the Service.
6.13.2. If necessary, to freeze transactions and use.
